Join Beach Volley Ventures and Lifting the Mood for a women-focused outdoor wellness and beach volleyball experience in Riverside Park. The event begins with a Pilates sculpt session led by Geena Gurman, Pilates & Sculpt instructor and founder of Pajamalates by G, using Lifting the Mood weighted products. The experience is followed by a beginner-friendly beach volleyball session focused on movement, confidence, teamwork, and fun. Designed for women who want to move, connect, and build strength in an uplifting outdoor environment.

Waiver | Beach Volley Ventures x Lifting the Mood Release & Assumption of Risk In consideration of the services and activities provided by Beach Volley Ventures / NYC Beach Volley Ventures (“BVV”), Lifting the Mood, Geena Gurman / Pajamalates by G, and their respective owners, instructors, coaches, employees, contractors, volunteers, representatives, sponsors, affiliates, and all persons or entities acting in any capacity on their behalf (collectively referred to herein as the “Released Parties”), I hereby agree to release, indemnify, and discharge the Released Parties on behalf of myself, my spouse, my children, my parents, my heirs, assigns, personal representatives, and estate as follows: ONE — Acknowledgment of Risks I acknowledge that participation in Pilates, sculpt training, wellness activities, fitness instruction, beach volleyball, recreational sports, outdoor events, transportation to and from activities, and any related event activities involves known and unanticipated risks that could result in illness, physical or emotional injury, paralysis, permanent disability, death, property damage, or other losses to myself, my child, or third parties. These risks include, but are not limited to: Slips, trips, and falls Muscle strains, soreness, sprains, fractures, and tears Injuries related to exercise equipment and weighted products Injuries resulting from volleyball activity and athletic movement Head, neck, back, or spinal injuries Heat exhaustion, dehydration, allergic reactions, and outdoor environmental conditions Exposure to bacteria, viruses, or infectious diseases including COVID-19 Negligence of other participants Improper use of equipment My own physical condition or limitations Emotional stress or psychological injury I understand that these risks cannot be completely eliminated without jeopardizing the essential qualities of the activities. I further acknowledge that all medical expenses arising from participation are solely my responsibility. TWO — Assumption of Risk I expressly agree and promise to voluntarily accept and assume all risks existing in these activities, both known and unknown. My participation, and/or the participation of any minor child or legal dependent under my supervision, is purely voluntary, and I elect to participate despite the risks. THREE — Release & Indemnification I hereby voluntarily release, forever discharge, and agree to indemnify, defend, and hold harmless: Beach Volley Ventures / NYC Beach Volley Ventures Lifting the Mood Geena Gurman / Pajamalates by G All instructors, coaches, employees, volunteers, contractors, sponsors, partners, affiliates, and venue representatives from any and all claims, demands, liabilities, damages, actions, causes of action, costs, or expenses of any kind arising out of or related to participation in the event, INCLUDING ANY CLAIMS ARISING FROM THE NEGLIGENCE OF THE RELEASED PARTIES. This release applies to all injuries, losses, damages, or claims suffered by me, my child, legal dependent, or any person for whom I am legally responsible. FOUR — Medical Responsibility I certify that I am physically able to participate in these activities and have not been advised otherwise by a qualified medical professional. I understand that I am solely responsible for determining my own physical fitness and capability to participate. I further certify that I maintain adequate medical and health insurance coverage or accept full responsibility for any medical expenses incurred. FIVE — Media Release By participating in this event, I grant permission to Beach Volley Ventures, Lifting the Mood, Geena Gurman / Pajamalates by G, and affiliated partners to photograph, record, and use my likeness, voice, image, and participation in video, photography, digital media, social media, advertising, marketing materials, and promotional content without compensation or approval rights. If I do not wish to appear in media content, I understand it is my responsibility to notify event organizers in writing prior to participation. SIX — Governing Law & Arbitration I agree that any dispute, controversy, or claim arising out of or relating to this agreement or participation in the activities shall be governed by the laws of the State of New York. Any disputes shall be resolved exclusively through binding arbitration in New York, New York, administered by the American Arbitration Association (AAA) or JAMS. I waive any right to participate in class action litigation or representative proceedings against the Released Parties. If any provision of this agreement is found unenforceable, the remaining provisions shall remain in full force and effect. AGREEMENT BY REGISTERING FOR OR PARTICIPATING IN THIS EVENT, I ACKNOWLEDGE THAT I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE, AND AGREE TO BE BOUND BY ITS TERMS FREELY AND VOLUNTARILY. IF PARTICIPATING ON BEHALF OF A MINOR, I CERTIFY THAT I AM THE PARENT OR LEGAL GUARDIAN OF THE PARTICIPANT AND AGREE TO THESE TERMS ON THEIR BEHALF.
