The consumer goods supply chain has changed structurally over the past decade, and bargaining power across the value chain has shifted with it. The upcoming review of the UTP Directive is a chance to ask whether the current framework still reflects that reality.
The Directive has improved protection against certain unfair practices. But questions remain about how buyer concentration is reshaping negotiations, and whether enforcement mechanisms are strong enough to act on the practices they're meant to prevent. Too often, discussions on pricing and affordability focus on outcomes without examining the underlying commercial dynamics—how prices are actually formed and how negotiating power is distributed.
