Everyone is saying the EU AI Act has been delayed.
That is only half the story.
The Digital Omnibus delayed many of the requirements affecting high-risk AI systems.
But it did not delay the entire EU AI Act.
From Sunday, 2 August 2026, a major new phase of the Act begins.
This includes the Article 50 transparency regime covering areas such as:

• Marking certain AI-generated or manipulated content
• Disclosing deepfakes
• Informing people about the use of emotion-recognition and biometric-categorisation systems
• Disclosing certain AI-generated text published to inform the public
There are important exceptions, transitional arrangements and technical details that most people discussing the Act are completely missing.
And getting this wrong could be expensive.
Non-compliance with Article 50 can attract penalties of up to €15 million or 3% of an organisation’s total worldwide annual turnover.
So no, the EU AI Act has not simply gone away until 2027.
Organisations need clarity now.
