This panel examines what “good” looks like in crypto and digital asset businesses, through both legal practitioner and trustee lenses, from regulatory expectations and governance structures, to the control frameworks that support safe operation, scaling, and resilience under stress. Drawing on practical experience, the discussion highlights how well-run organisations design oversight, accountability, and risk management in practice. We’ll then shift gear to failure mode, analysing common governance breakdowns, control failures, and the early warning signs seen in troubled crypto structures. Finally, the panel explores the ugly face of how minor weaknesses escalate into major crises, and what legal advisers and trustees typically encounter first when things go wrong.
