Startup Hiring Pitfalls: Legal Lessons You Don't Want to Learn the Hard Way

There's a gap between "we need to hire" and knowing what can legally go wrong along the way — and this session fills it with a high-level, practical discussion on the employment law issues that startups often overlook until it's too late. Join Littler's Joon Hwang and Tiffany Tse as they walk you through real-world horror stories and cautionary tales that startups may face when building a team. This session will also conclude with an interactive Q&A/Ask Me Anything (AMA) segment, giving attendees the opportunity to ask questions and engage directly with the presenters on the startup employment law challenges keeping founders up at night.

Tiffany Tse helps employers navigate the full spectrum of labor and employment challenges. She regularly handles matters involving restrictive covenants, accommodations, discrimination, retaliation, hostile work environment, sexual harassment, and wrongful termination. Tiffany has guided clients through every stage of the litigation process and has achieved strong results in state and federal courts, as well as before agencies like the EEOC, Departments of Labor, and local civil and human rights offices. Tiffany works with employers of all sizes—from entrepreneurs and start-ups to companies with national and international teams. She advises clients across a wide range of industries, including retail, manufacturing, hospitality, restaurants, technology, healthcare, fitness, and government contracting. Beyond litigation, Tiffany conducts internal investigations, drafts and negotiates employment and severance agreements, and helps employers refresh their handbooks and policies to keep up with changing federal and state requirements.

Joon Hwang is a management-side employment and labor law litigator and trial attorney with a cross-border practice spanning national and international jurisdictions. He serves as relationship partner to some of the world's most prominent publicly traded and privately held companies, providing outcome-driven counsel and litigation leadership across industries including healthcare, high-growth technology, fashion and luxury retail, government contracting, clean energy, and construction and real estate. Joon is routinely entrusted to lead high-profile matters, including bet-the-company litigation, reputationally sensitive disputes, and cases involving senior executives and board-level scrutiny, spanning discrimination and retaliation claims, whistleblower and Sarbanes-Oxley issues, executive compensation disputes, restrictive covenant and trade secret litigation, and wage and hour class actions. He also co-chairs Littler's SOAR Program, mentoring newly hired attorneys and supporting inclusive, diverse teams firmwide.
